Contribution Terms of Service

The Digital Archive of Newark Architecture (DANA) welcomes submissions of community content that documents the history and built environment of Newark. By contributing to DANA, you acknowledge that any submission made may be used, transferred, shared, modified, removed, published, and displayed on the DANA website and related online platforms. You hereby irrevocably grant us the non-exclusive right to use your content by any and all means and methods and in any and all media and platforms, now known or hereafter devised, throughout the world, in perpetuity, including without limitation, in the advertising, publicity and promotion of DANA. Submissions made to DANA may also be included in or made available through other digital formats (e.g. social media, online exhibits, or the NJIT website). We reserve the right in our sole discretion to modify, refuse to publish, un-publish, or remove contributions, in whole or in part, without further notice to you at any time that do not meet our standards or are deemed inappropriate, defamatory, in violation of copyright or trademark laws, or are otherwise not within our collecting scope. By making a contribution, you agree to its display and publication on DANA and in other related uses. 

If you submit content for publication to DANA, in any format, you acknowledge that you have all necessary rights, including copyright, in the content that you are contributing to the DANA website and that you accept the content will be accessible to the public. You agree at all times to indemnify, defend and hold DANA and its agents, representatives, sponsors and volunteers harmless from and against any and all suits, claims, liabilities, demands, costs, or damages arising out of DANA’s use of your content. We may assign your permission to use your content, in whole or in part, to any third party, and all rights granted to us hereunder shall inure to the benefit of any such assignees or licensees. We shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of your content.

Under no circumstances shall we be liable for any indirect, incidental, special, consequential, direct of exemplary damages, relating to our use or publication of your content, including without limitation, unauthorized use, access to or alteration of your content by third parties. By providing us with your content, you acknowledge that you have read, understood and agree to be bound by this statement and hereby waive any claims against DANA and its agents, representatives, sponsors and volunteers regarding the use and publication of your content. DANA expressly reserves the right to make any changes to your content and the DANA website at any time, without prior notice to you or its users. Any legal action concerning our use of your content shall be governed by the laws of the State of New Jersey and located in Essex County.
